La financiarizaci\u00f3n de la vivienda, determinados modelos de desarrollo urbano y las pol\u00edticas que anteponen el beneficio econ\u00f3mico a los derechos humanos est\u00e1n dejando a millones de personas sin hogar. En la <strong>Nueva Agenda Urbana<\/strong>, aprobada en H\u00e1bitat III en Quito, los gobiernos reafirmaron su compromiso de prevenir los desalojos forzosos y arbitrarios y los desplazamientos, y de garantizar una reubicaci\u00f3n adecuada cuando el desplazamiento sea inevitable. Asimismo, reconocieron la funci\u00f3n social de la tierra y la vivienda y adoptaron la visi\u00f3n del <strong>Derecho a la Ciudad<\/strong>. global_colors_info=\u00bb{}\u00bb sticky_enabled=\u00bb0&#8243;]\n<p><strong>El derecho a una vivienda adecuada y a la protecci\u00f3n contra los desalojos forzosos no desaparece ante las presiones del mercado, los intereses del Estado o los beneficios empresariales.<\/strong><\/p>\n<ul>\n<li><b>Los Estados<\/b><span style=\"font-weight: 400;\"> tienen obligaciones vinculantes en virtud del derecho internacional de los derechos humanos de respetar, proteger y hacer efectivo el derecho a la vivienda, lo que incluye prevenir los desalojos forzosos, regular a los actores privados y garantizar el acceso a la justicia y reparaci\u00f3n para todas las personas afectadas.<\/span><\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.refworld.org\/legal\/general\/cescr\/1997\/53063\"><span style=\"font-weight: 400;\">Comit\u00e9 de Derechos Econ\u00f3micos, Sociales y Culturales de las Naciones Unidas (CESCR), <\/span><i><span style=\"font-weight: 400;\">Observaci\u00f3n general n.\u00ba 7: El derecho a una vivienda adecuada (art. 11.1 del Pacto): Desalojos forzosos<\/span><\/i><span style=\"font-weight: 400;\">, E\/1998\/22<\/span><\/a><\/p>\n<ul>\n<li><b>Los actores privados y el mercado<\/b><span style=\"font-weight: 400;\">, incluidos los promotores inmobiliarios, las instituciones financieras y las plataformas de alquiler a corto plazo, tambi\u00e9n tienen responsabilidades en materia de derechos humanos. Bas\u00e1ndose en los<\/span><a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/documents\/publications\/guidingprinciplesbusinesshr_en.pdf\"> <span style=\"font-weight: 400;\">Principios Rectores de las Naciones Unidas sobre las Empresas y los Derechos Humanos<\/span><\/a><span style=\"font-weight: 400;\">, las empresas deben respetar los derechos humanos, evitar contribuir al desplazamiento y cooperar en la reparaci\u00f3n cuando se produzcan da\u00f1os. Exigirles responsabilidades es igualmente urgente.<\/span><\/li>\n<\/ul>\n<p><strong><span style=\"font-size: 14pt;\">Cuando falla la prevenci\u00f3n, debe seguir una reparaci\u00f3n efectiva: restituci\u00f3n, indemnizaci\u00f3n, rehabilitaci\u00f3n y garant\u00edas de no repetici\u00f3n.
